The following General Terms and Conditions (GTC) apply to the use of this website and the business relationship between Tummzy GmbH ( www.tummzy.com / Tummzy GmbH, Maihofstrasse 81, 6006 Lucerne) and its customers, in the version currently available and valid at the time the website is accessed or goods are ordered. The offer on this website is directed exclusively to customers residing in Switzerland and Liechtenstein.
A customer is defined as any natural or legal person who maintains a business relationship with Tummzy GmbH. The General Terms and Conditions, the delivery and payment terms, and the privacy policy may be amended from time to time. Tummzy GmbH requests that you read these terms carefully each time you visit the website and each time you order goods.
These Terms and Conditions apply exclusively. Any conflicting, supplementary, or deviating terms and conditions require the express written confirmation of Tummzy GmbH to be valid. By using this website or ordering goods, the customer confirms that they fully accept these Terms and Conditions, including the delivery and payment terms.
Should individual provisions of these Terms and Conditions prove to be invalid or unenforceable or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

Prices
Unless otherwise stated, Tummzy GmbH's prices include statutory value-added tax, any advance recycling fees (VRG), copyright fees, and shipping charges within Switzerland and Liechtenstein. Prices are strictly net in Swiss francs (CHF). Subject to technical changes, errors, and misprints; in particular, Tummzy GmbH reserves the right to make price changes at any time and without prior notice. Consulting and support services are not included in the sales prices.

Conclusion of contract
The offers on this website represent a non-binding invitation to the customer to order products and/or services from Tummzy GmbH. By placing an order through this website, including acceptance of these Terms and Conditions, the customer submits a legally binding offer to conclude a contract. Tummzy GmbH then sends an automatic "order confirmation" via email, confirming that Tummzy GmbH has received the customer's offer. Placed orders are binding for the customer. Unless otherwise stated, there is no right of return or withdrawal.
The contract is concluded as soon as Tummzy GmbH sends an acceptance declaration by email, confirming the dispatch of the ordered products or services.
Orders will only be shipped after full payment has been received and provided the goods are available. If, after conclusion of the contract, it becomes apparent that the ordered goods cannot be delivered or cannot be delivered in full, Tummzy GmbH is entitled to withdraw from the entire contract or from a part of the contract. If the customer's payment has already been received by Tummzy GmbH, the payment will be refunded to the customer. If no payment has yet been made, the customer is released from the payment obligation. Tummzy GmbH is not obligated to provide a replacement delivery in the event of termination of the contract.
5.
Payment options and retention of title
The customer has access to the payment options specified during the ordering process.
Tummzy GmbH reserves the right to exclude customers from certain payment options or to insist on advance payment without giving reasons.
After expiry of the aforementioned payment period, the entire invoiced amount becomes due and default occurs automatically without notice.
In case of late payment, Tummzy GmbH may commission a debt collection agency in Germany or abroad or assign the claim.
In case of late payment, interest of 14.5% per year and a reminder fee of up to CHF 20 per reminder may be charged.
If a third party is commissioned to collect outstanding payments, further fees and additional costs may be incurred in accordance with the table of the (VSI) Association of Swiss Debt Collection Trustee Institutes ( https://inkassoverband.ch/ ), to which you expressly agree.
The products delivered to the customer remain the property of Tummzy GmbH until full payment has been made.
6.
Delivery, obligation to inspect, notification of defects and return
Deliveries are sent by mail to the address specified by the customer in the order. Invoicing is carried out according to the specified ordering process and payment options. Upon shipment, the benefit and risk are transferred to the customer, to the extent permitted by law.
If the delivery cannot be delivered or if the customer refuses to accept the delivery, Tummzy GmbH may terminate the contract after sending a notice of complaint by email to the customer and setting a reasonable deadline, and charge the customer for the costs of the effort.
The customer is obliged to inspect the delivered goods immediately upon receipt of the delivery and to report any defects for which Tummzy GmbH provides a guarantee immediately in writing by letter or email to the address in the imprint .
Returns to Tummzy GmbH are at the customer's expense and risk. The customer must send the goods in their original packaging, complete with all accessories, and together with the delivery note and a detailed description of the defects to the return address specified in the Tummzy GmbH imprint.
If the inspection by Tummzy GmbH reveals that the goods do not have any detectable defects or that these are not covered by the manufacturer's warranty, Tummzy GmbH may charge the customer for the costs of returning the goods or any disposal.
7.
Right of withdrawal
The customer is granted a right of withdrawal within 14 calendar days of receiving the goods. This period is deemed to have been met if the customer sends the written cancellation to Tummzy GmbH by mail (Tummzy GmbH, Maihofstrasse 81, 6006 Lucerne) or by email (info@tummzy.com) within the deadline. No reason is required for the cancellation.
Exercising the right of withdrawal will result in a reversal of the contract. The customer must return the goods within 14 calendar days in their original packaging, complete with all accessories, and together with the delivery note to the return address specified by Tummzy GmbH (Tummzy GmbH, Maihofstrasse 81, 6006 Lucerne). Returns to Tummzy GmbH are at the customer's expense and risk. Any payment already made will be refunded to the customer within 20 calendar days, provided Tummzy GmbH has already received the goods back or the customer can provide proof of shipment.
Tummzy GmbH reserves the right to demand appropriate compensation for damage, excessive wear and tear, or loss of value due to improper handling and to deduct the loss in value from the purchase price already paid or to invoice the customer.
No right of withdrawal is granted in the following cases:

(i) Where the contract has an element of chance, in particular because the price is subject to fluctuations over which the supplier has no control.

(ii) Where the contract concerns a movable item which is made to the consumer's specifications or which is clearly tailored to his personal needs;

(iii) Where the contract is for the provision of services and the contract is to be fully performed by the supplier with the prior express consent of the consumer before the withdrawal period has expired.
8.
Warranty
Tummzy GmbH strives to deliver goods of impeccable quality. For defects reported in a timely manner, Tummzy GmbH guarantees the freedom from defects and functionality of the item purchased by the customer for the statutory warranty period, which is generally two years from the delivery date. Tummzy GmbH reserves the right to fulfill the warranty through free repair, equivalent replacement, or refund of the purchase price. Further claims are excluded.
The warranty does not cover normal wear and tear, the consequences of improper handling or damage by the customer or third parties, or defects resulting from external circumstances.
Tummzy GmbH is unable to provide any assurances or guarantees regarding the timeliness, completeness, and accuracy of the data, nor regarding the constant or uninterrupted availability of the website, its functionalities, integrated hyperlinks, and other content. In particular, it neither represents nor guarantees that the use of the website will not infringe the rights of third parties not owned by Tummzy GmbH.

Liability
Tummzy GmbH excludes all liability, regardless of its legal basis, as well as claims for damages against Tummzy GmbH and any auxiliary persons and vicarious agents. In particular, Tummzy GmbH is not liable for indirect damages and consequential damages, lost profits, or other personal injury, property damage, or purely financial loss suffered by the customer. Further mandatory statutory liability, for example, for gross negligence or unlawful intent, remains reserved.
Tummzy GmbH uses hyperlinks solely to simplify customer access to other websites. Tummzy GmbH cannot know the detailed content of these websites, nor does it assume liability or other responsibility for their content.
10.
Data protection
Tummzy GmbH may process and use the data collected during the contract conclusion process to fulfill its obligations under the purchase agreement, as well as for marketing purposes. The data necessary to fulfill the service may also be passed on to commissioned service partners (logistics partners) or other third parties.

Further provisions
Tummzy GmbH expressly reserves the right to change these General Terms and Conditions at any time and to put them into effect without notice.
In the event of any dispute, Swiss substantive law shall apply exclusively, excluding any conflict of law provisions. The UN Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention) is explicitly excluded.
The place of jurisdiction is Lucerne, unless the law provides for mandatory jurisdiction.

All rights, including copyrights, to these Terms and Conditions are held by Tummzy GmbH.
Any reproduction, distribution, or other use is prohibited and only permitted with the express written consent of Tummzy GmbH. In the event of a violation of this provision, Tummzy GmbH reserves the right to take all legal action.
